Odyon is built by creators, for creators — and that starts with respecting copyright. This page explains exactly how to report infringing content and how we respond.
1. Overview
Odyon respects the intellectual property rights of creators and expects its users to do the same. This policy describes how copyright holders can report infringing material on the Odyon platform — including content published to the public Explore gallery and material uploaded or entered by users (such as audio files or song lyrics) — in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
2. Designated Copyright Agent
All copyright notices and counter-notices should be sent to our designated agent: Odyon Audio — Copyright Agent Email: copyright@odyon.ai Please use the subject line "DMCA Takedown Notice" or "DMCA Counter-Notice" so we can route your message quickly.
3. Filing a Takedown Notice
To be effective under 17 U.S.C. § 512(c)(3), your notice must include: 1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. 2. Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works are covered). 3. Identification of the material claimed to be infringing, with information reasonably sufficient to locate it on the platform (for example, the URL of the creation in the Explore gallery). 4. Your contact information — name, address, telephone number, and email address. 5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law. 6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
4. Our Response
Upon receipt of a valid takedown notice, we will promptly remove or disable access to the identified material and notify the user who posted it, providing them a copy of the notice. We may also, at our discretion, remove material proactively when infringement is apparent.
5. Counter-Notice Procedure
If you believe your material was removed by mistake or misidentification, you may submit a counter-notice to copyright@odyon.ai containing: 1. Your physical or electronic signature. 2. Identification of the removed material and its location before removal. 3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification. 4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your district (or, if outside the United States, any judicial district in which Odyon may be found), and that you will accept service of process from the original complainant. If we receive a valid counter-notice, we will forward it to the original complainant. Unless they notify us within 10–14 business days that they have filed a court action, we may restore the removed material.
6. Repeat Infringers
Odyon maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. Strikes are recorded against accounts that are the subject of valid takedown notices, and accumulated strikes lead to account termination without refund.
7. Misrepresentation Warning
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages — including costs and attorneys' fees — incurred by the alleged infringer, the copyright owner, or Odyon. Please make sure your notice is accurate before submitting it.
